Who is the Data Controller?

The legal entity responsible for the processing of your Personal Information (as defined below) is Club CPG, LLC, a Delaware corporation, having its registered offices at 340 S LEMON AVE #2487, WALNUT, CA 91789. This Privacy Policy sets out the conditions under which CPG, as data controller under may process your Personal Information.  

Please also note that some Personal Information can be collected by CPG through a smartphone. You acknowledge and agree that (i) Personal Information may be collected and processed by the manufacturer of the smartphone and provider of your cellular services, each as data controller for its own respective purposes, under the terms and conditions of each’s own separate privacy policy, as the case may be; (ii) such manufacturer and/or cellular service provide is exclusively responsible regarding such collection and processing; and (iii) CPG shall not be liable to you in relation to such manufacturer’s and/or cellular service provider’s processing of Personal Information.

Does CPG Collect Any Information About Users Under Age 18?

CPG does not knowingly solicit or collect information from anyone under the age of 18, and every part of the Services is directed at persons 18 years of age or older.  If you are the parent or guardian of a child under the age of eighteen (18), or the legal age of contract majority, and have authorized your child to use your mobile device, computer or provided a mobile device to such child, CPG urges you to instruct your child never to give out his or her real name, address, phone number, email address or other personally identifying information while using the Services. CPG recommends that the Internet browsing behavior of any child should be carefully supervised by a responsible adult at all times.  There are no applications or devices in the Services which allow for the verification of your age. All information used with the Services will be treated the same as information given by an adult. If CPG discovers that Personal Information of a child under 13 has been collected without parental or guardian consent, CPG will take reasonable steps to delete such Personal Information, which may require CPG to delete the child’s access. What CPG Collects and Why

To enhance the content contained on or in the Services, CPG may gather and store certain general information about your visit or use.  “General Information” is information about you or your activities through which you cannot be identified.  CPG collects this General Information and may use it to generate generic or aggregate statistics about visitors to and users of the Services.  In situations where it is possible to do so, General Information may be linked to Personal Information.“Personal Information” is information through which you can be identified. Providing your Personal Information to CPG is your choice.  CPG maintains one or more databases to store your Personal Information and may keep such information indefinitely.To participate in the various services provided on or in the Services, CPG asks for Personal Information, which may include your IP address(es) and email address(es). Incubator Application Data

When applying to be a part of CPG’s Incubator program, CPG collects: first name, last name, email address, ETH wallet address, information about your project, project materials, pitch video, and gives you the option to allow your pitch video to be shared on social media

Blockchain

Part of CPG’s business involves its NFTs which use the Ethereum blockchain. The Ethereum blockchain is decentralized and is made up of digitally recorded data in what is called “blocks.” These blocks are linked chronologically, which effectively means that data is very difficult, if not impossible, to change once it has been recorded. Because the Ethereum blockchain is decentralized, data can be stored all over the world. There is also no single person or entity that controls or administers it. Nor is there any centralized location where it is stored. Thus, transactions on the blockchain are generally referred to as “immutable,” and cannot be changed or deleted. In order to provide certain of the Services, CPG requires your public Ethereum blockchain wallet address. It is your decision as to whether you would like to have access to these Services, to transact on the Ethereum blockchain, and/or to share your Ethereum wallet address’ public key.Because of the decentralized and immutable nature of the Ethereum blockchain, this may affect your ability to exercise certain privacy rights you may have with respect to your Personal Information. If you want to ensure that your privacy rights with respect to your blockchain information are not affected, then you should not use your ETH wallet address to transact on the blockchain or access the Services which require your ETH wallet address, as certain privacy rights may not be fully available or exercisable by you or CPG. By using the Services, you acknowledge that the Ethereum blockchain is available to the public and any Personal Information shared on the blockchain will become publicly available.

Social Media

The Services may include social media features, including links to share, post or link CPG’s content through your accounts with third party social media services. If you choose to interact with social media features on or from the Services, or if you are logged in to your social media accounts while using the Services, social media services may collect information about your use of the Services. Information collected by third party social media services is governed by the privacy policies of those third parties, not CPG.CPG may collect your social media username or ID, social media plug-in information, and URL clickstream to, through and from the Services (including date and time). Information collected by social media sites may include names, titles or descriptions of videos or content viewed through your use of the Services. Your use of the Services and any third-party social media services constitutes your agreement and consent to the collection and use of information about the videos and content you view through the Services.

Location Data

Location data, as specified above, may be collected from your use of the Services.  Location data is generally provided by a Global Positioning System (GPS) and can identify the exact location of the mobile device using the Services. By authorizing the Services to access your device’s location data, which you can do in your mobile device’s settings, you consent to the collection of such location data for the purposes set forth above. Location data will not be processed for longer than necessary for such purposes and will not be processed for purposes other than those specified in this Privacy Policy. You can withdraw your consent to the processing of your location data by disabling the geolocation function on your mobile device. 

Third Party Advertising

At this time, CPG does not collect information about your activity on the Services to be shared with third parties for advertising purposes. CPG also does not allow third parties to collect information about your activity on the Services to be used for third party advertising purposes. Please note, social media services may have their own third-party advertising which is generated from or uses your Personal Information. If you are logged into your social media account while accessing or using the Services, such social media services may serve you third-party advertisements. Such third-party advertisements are governed by the policies of the applicable social media service, not CPG.

Third Party Analytics

CPG and the third-party technology service providers, ad exchanges, ad networks, advertisers, agencies, and ad servers CPG works with may use third-party analytics services to evaluate your use of the Services, compile reports on activity, collect demographic data, analyze performance metrics, and collect and evaluate other information relating to the Services and mobile and Internet usage. Video Content

CPG may collect, use and share information about videos you view on or in the Services with CPG’s third-party service providers as described in this Privacy Policy. CPG may also collect information from third parties regarding videos you view on third party sites. You agree and consent to this sharing and collection for two years or until you affirmatively withdraw consent. You must send us a request in writing, at our contact information below, to withdraw such consent. You may also be able to control information shared with CPG through third parties, such as social media services, through your privacy settings on those services.By associating your social media or other third-party website account with your use of the Services and authorizing CPG to have access to this information, you consent to this collection, use, and disclosure of video and content viewing information to these social media services and websites in accordance with this Privacy Policy.

How Does CPG Collect Information?

In addition to the above, your information is collected from the Services, through email and/or through online applications or forms you complete, requests for CPG or information about the Services, entering sweepstakes or prize promotions, taking surveys, reporting problems, information you volunteer to CPG, and through any of your other activities with CPG.  The Personal Information that CPG collects depends on the nature of your activities.

How Does CPG Use the Information CPG Collects?

Personal Information you volunteer is used by CPG for internal verification, to complete requested transactions, to obtain and deliver the requested products, to ensure appropriate legal use of the Services, to provide you notification about updates to the Services, and to help provide you with technical support for the Services. Specifically, CPG uses the information it collects about you as follows:

a. As set forth  above;
b. To notify you of changes to the Services or any of CPG’s agreements, terms and policies with respect or related to the Services, including this Privacy Policy;
c. To solicit your feedback about the Services;
d. To communicate with you regarding messages you send us;

h. To comply with administrative, regulatory and legal requirements.

To the greatest extent commercially possible, CPG shall process aggregate data (which is data that neither identifies you nor can be linked to you, such as statistic data), pseudonymized or anonymized data, rather than Personal Information, when the purposes of such processing can be achieved in the same way.

CPG may anonymize Personal Information and share it in an aggregated form with third parties, advertisers and/or business partners in order to analyze the Services, improve the Services and user experience, or for other similar purposes. The use and disclosure of such anonymous information is not subject to any restrictions under this Privacy Policy.

How Does CPG Share Your Information with Third Parties?

CPG does not share your Personal Information with any third parties, except as described in this Privacy Policy. CPG has not sold any of your Personal Information within the preceding twelve (12) months.CPG shares information about you, including your Personal Information, with third parties, to:

a. CPG’s service providers, which are business partners, suppliers and subcontractors that assist CPG in providing and maintaining the Services. For example, CPG may use companies to help provide products or services, like an email company that may deliver our newsletters, a help desk partner that provides or assists with customer support, a third-party fulfillment company to administer prize promotions, a data processor, or any other third party that is needed to assist in the completion of transactions or the provision of goods or services you request or CPG provides;

CPG may also disclose your Personal Information: 

a. To comply with any applicable law or legal process, including in response to judicial, administrative, or governmental subpoenas, warrants or orders served on CPG;

When CPG believes it is necessary to protect and defend CPG’s rights or property, to enforce the provisions of this Privacy Policy and/or any other CPG terms and conditions, policies or agreements (including our Terms of Service), to guard against fraud, and/or to prevent harm to CPG, its members and any other person or entity;
c. In the event of a change of ownership, corporate sale, acquisition, merger, reorganization, sale of assets, or dissolution or similar event; ord. A petition for relief is filed under U.S. Bankruptcy laws for or against CPG or if CPG becomes subject to an order of appointment of a trustee or receiver.

CPG reserves the right to release and/or use all information contained within CPG’s databases, access logs or other records concerning you, including your Personal Information, if you violate this Privacy Policy, the Terms of Service, or any CPG terms and conditions, or other rules, policies, notices, agreements or guidelines, or if you intentionally or unintentionally partake (or are reasonably suspected of partaking) in any illegal activity, including but not limited to hacking, even without a subpoena, warrant or other court order, and to release such information in response to court and governmental orders, civil subpoenas, discovery requests and as otherwise required by law and/or to initiate CPG’s own legal proceedings. CPG cooperates with law enforcement agencies in identifying those who may be using the Services (or any part thereof) for illegal activities.  CPG also reserves the right to report any suspected illegal activity to law enforcement individuals or to entities for investigation or prosecution.

What About Information Shared on Community Services?

CPG may make message boards, blogs, reviews, allow comments and provide other community services available to you on the Services. Please understand that any information that is disclosed by you in these areas becomes public information.  When you disclose such information in a comment or on message board, blog, review or any other public forum, you do so at your own risk.  CPG has no control over its use, and you should exercise caution when deciding to disclose your Personal Information or any other information about yourself.  The information presented in these areas reflects the views of the individual users, providers or hosts and does not necessarily reflect the views of CPG.  CPG reserves the right (but has no obligation) to monitor the use of message boards, blogs, reviews, or other public forums on the Services.

Does CPG Use De-Identified Information?

CPG may take your Personal Information and make it non-personally identifiable, either by combining it with information about other individuals (aggregating your information with information about other individuals), or by removing characteristics (such as your name) that make the information personally identifiable to you (de-personalizing your information).  Given the nature of this information, there are no restrictions under this Privacy Policy upon the right of CPG to aggregate or de-personalize your Personal Information, and CPG may use and/or share with third parties the resulting non-personally identifiable information in any manner in CPG’s sole discretion.

How Does CPG Maintain and Secure the Personal Information CPG Collects?

Blockchain

Part of CPG’s business involves its NFTs which use the Ethereum blockchain. The Ethereum blockchain is decentralized and is made up of digitally recorded data in what is called “blocks.” These blocks are linked chronologically, which effectively means that data is very difficult, if not impossible, to change once it has been recorded. Because the Ethereum blockchain is decentralized, data can be stored all over the world. There is also no single person or entity that controls or administers it. Nor is there any centralized location where it is stored. Thus, transactions on the blockchain are generally referred to as “immutable,” and cannot be changed or deleted. In order to provide certain of the Services, CPG requires your public Ethereum blockchain wallet address. It is your decision as to whether you would like to have access to these Services, to transact on the Ethereum blockchain, and/or to share your Ethereum wallet address’ public key.Because of the decentralized and immutable nature of the Ethereum blockchain, this may affect your ability to exercise certain privacy rights you may have with respect to your Personal Information. If you want to ensure that your privacy rights with respect to your blockchain information are not affected, then you should not use your ETH wallet address to transact on the blockchain or access the Services which require your ETH wallet address, as certain privacy rights may not be fully available or exercisable by you or CPG. By using the Services, you acknowledge that the Ethereum blockchain is available to the public and any Personal Information shared on the blockchain will become publicly available.

Social Media

The Services may include social media features, including links to share, post or link CPG’s content through your accounts with third party social media services. If you choose to interact with social media features on or from the Services, or if you are logged in to your social media accounts while using the Services, social media services may collect information about your use of the Services. Information collected by third party social media services is governed by the privacy policies of those third parties, not CPG.CPG may collect your social media username or ID, social media plug-in information, and URL clickstream to, through and from the Services (including date and time). Information collected by social media sites may include names, titles or descriptions of videos or content viewed through your use of the Services. Your use of the Services and any third-party social media services constitutes your agreement and consent to the collection and use of information about the videos and content you view through the Services.

Location Data

Location data, as specified above, may be collected from your use of the Services.  Location data is generally provided by a Global Positioning System (GPS) and can identify the exact location of the mobile device using the Services. By authorizing the Services to access your device’s location data, which you can do in your mobile device’s settings, you consent to the collection of such location data for the purposes set forth above. Location data will not be processed for longer than necessary for such purposes and will not be processed for purposes other than those specified in this Privacy Policy. You can withdraw your consent to the processing of your location data by disabling the geolocation function on your mobile device. 

Third Party Advertising

At this time, CPG does not collect information about your activity on the Services to be shared with third parties for advertising purposes. CPG also does not allow third parties to collect information about your activity on the Services to be used for third party advertising purposes. Please note, social media services may have their own third-party advertising which is generated from or uses your Personal Information. If you are logged into your social media account while accessing or using the Services, such social media services may serve you third-party advertisements. Such third-party advertisements are governed by the policies of the applicable social media service, not CPG.

Third Party Analytics

CPG and the third-party technology service providers, ad exchanges, ad networks, advertisers, agencies, and ad servers CPG works with may use third-party analytics services to evaluate your use of the Services, compile reports on activity, collect demographic data, analyze performance metrics, and collect and evaluate other information relating to the Services and mobile and Internet usage. Video Content

CPG may collect, use and share information about videos you view on or in the Services with CPG’s third-party service providers as described in this Privacy Policy. CPG may also collect information from third parties regarding videos you view on third party sites. You agree and consent to this sharing and collection for two years or until you affirmatively withdraw consent. You must send us a request in writing, at our contact information below, to withdraw such consent. You may also be able to control information shared with CPG through third parties, such as social media services, through your privacy settings on those services.By associating your social media or other third-party website account with your use of the Services and authorizing CPG to have access to this information, you consent to this collection, use, and disclosure of video and content viewing information to these social media services and websites in accordance with this Privacy Policy.

How Does CPG Collect Information?

In addition to the above, your information is collected from the Services, through email and/or through online applications or forms you complete, requests for CPG or information about the Services, entering sweepstakes or prize promotions, taking surveys, reporting problems, information you volunteer to CPG, and through any of your other activities with CPG.  The Personal Information that CPG collects depends on the nature of your activities.How Does CPG Use the Information CPG Collects?Personal Information you volunteer is used by CPG for internal verification, to complete requested transactions, to obtain and deliver the requested products, to ensure appropriate legal use of the Services, to provide you notification about updates to the Services, and to help provide you with technical support for the Services. Specifically, CPG uses the information it collects about you as follows:

b. To notify you of changes to the Services or any of CPG’s agreements, terms and policies with respect or related to the Services, including this Privacy Policy;
c. To solicit your feedback about the Services;

e. To enable CPG to provide, improve and maintain the Services, including administration and internal operations such as data usage and analysis, research, testing, and troubleshooting;
f. To help keep the Services safe and secure;
g. To administer promotional programs; and
h. To comply with administrative, regulatory and legal requirements.

To the greatest extent commercially possible, CPG shall process aggregate data (which is data that neither identifies you nor can be linked to you, such as statistic data), pseudonymized or anonymized data, rather than Personal Information, when the purposes of such processing can be achieved in the same way.

CPG may anonymize Personal Information and share it in an aggregated form with third parties, advertisers and/or business partners in order to analyze the Services, improve the Services and user experience, or for other similar purposes. The use and disclosure of such anonymous information is not subject to any restrictions under this Privacy Policy.

How Does CPG Share Your Information with Third Parties?

CPG does not share your Personal Information with any third parties, except as described in this Privacy Policy. CPG has not sold any of your Personal Information within the preceding twelve (12) months.CPG shares information about you, including your Personal Information, with third parties, to:

a. CPG’s service providers, which are business partners, suppliers and subcontractors that assist CPG in providing and maintaining the Services. For example, CPG may use companies to help provide products or services, like an email company that may deliver our newsletters, a help desk partner that provides or assists with customer support, a third-party fulfillment company to administer prize promotions, a data processor, or any other third party that is needed to assist in the completion of transactions or the provision of goods or services you request or CPG provides;
b. Service providers and business partners who supplement information CPG collects with additional information about visitors or users of the Services and who help CPG better connect with CPG’s intended audience;
c. Analytics and search engine providers that aid CPG in the improvement and optimization of the Services;
d. Any of CPG’s parent companies, subsidiaries, joint ventures, or other companies under common control with CPG; and
e. To any other third party with your consent to do so.

CPG may also disclose your Personal Information: 

a. To comply with any applicable law or legal process, including in response to judicial, administrative, or governmental subpoenas, warrants or orders served on CPG;
b. When CPG believes it is necessary to protect and defend CPG’s rights or property, to enforce the provisions of this Privacy Policy and/or any other CPG terms and conditions, policies or agreements (including our Terms of Service), to guard against fraud, and/or to prevent harm to CPG, its members and any other person or entity;
c. In the event of a change of ownership, corporate sale, acquisition, merger, reorganization, sale of assets, or dissolution or similar event; ord. A petition for relief is filed under U.S. Bankruptcy laws for or against CPG or if CPG becomes subject to an order of appointment of a trustee or receiver.

CPG reserves the right to release and/or use all information contained within CPG’s databases, access logs or other records concerning you, including your Personal Information, if you violate this Privacy Policy, the Terms of Service, or any CPG terms and conditions, or other rules, policies, notices, agreements or guidelines, or if you intentionally or unintentionally partake (or are reasonably suspected of partaking) in any illegal activity, including but not limited to hacking, even without a subpoena, warrant or other court order, and to release such information in response to court and governmental orders, civil subpoenas, discovery requests and as otherwise required by law and/or to initiate CPG’s own legal proceedings. CPG cooperates with law enforcement agencies in identifying those who may be using the Services (or any part thereof) for illegal activities.  CPG also reserves the right to report any suspected illegal activity to law enforcement individuals or to entities for investigation or prosecution.

What About Information Shared on Community Services?

CPG may make message boards, blogs, reviews, allow comments and provide other community services available to you on the Services. Please understand that any information that is disclosed by you in these areas becomes public information.  When you disclose such information in a comment or on message board, blog, review or any other public forum, you do so at your own risk.  CPG has no control over its use, and you should exercise caution when deciding to disclose your Personal Information or any other information about yourself.  The information presented in these areas reflects the views of the individual users, providers or hosts and does not necessarily reflect the views of CPG.  CPG reserves the right (but has no obligation) to monitor the use of message boards, blogs, reviews, or other public forums on the Services.

Does CPG Use De-Identified Information?

CPG may take your Personal Information and make it non-personally identifiable, either by combining it with information about other individuals (aggregating your information with information about other individuals), or by removing characteristics (such as your name) that make the information personally identifiable to you (de-personalizing your information).  Given the nature of this information, there are no restrictions under this Privacy Policy upon the right of CPG to aggregate or de-personalize your Personal Information, and CPG may use and/or share with third parties the resulting non-personally identifiable information in any manner in CPG’s sole discretion.

How Does CPG Maintain and Secure the Personal Information CPG Collects?

CPG takes commercially reasonable measures to protect the security and confidentiality of your Personal Information, including measures to protect against unauthorized access, alteration, and disclosure.  These security measures include, for example, internal reviews of CPG’s data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where CPG stores Personal Information. When the use of the Services involves the transmission of Personal Information, CPG may use Transport Layer Security (“TLS”) technology to establish a secure connection between your computer or mobile device and CPG and/or the Services.  CPG may also allow the transmission of encrypted information from your computer or mobile device to CPG and/or the Services and back again.

CPG reserves the right to monitor all network and other traffic to and in the Services to identify and/or block unauthorized attempts or intrusions to upload or change information or cause damage to any of the Services in any manner.  Anyone using any of the Services expressly consents to such monitoring.Please be aware that no data transmission over the Internet or which is stored on a computer or mobile device connected to the Internet can be guaranteed to be 100% secure, so while CPG strives to protect your Personal Information, CPG cannot ensure or warrant the security of any information that you voluntarily give to us.

Country of Data Transfers

By using the Services, you consent to the collection, processing, storage and transfer of your information, including Personal Information, in and to the United States.
Can My Personal Information be Corrected or Deleted?

You cannot access your Personal Information contained in CPG’s database. Please note in order to protect the security of your information, you will be required to properly identify yourself before CPG can process such a request. This may include requiring you to provide proof of identity, such as an identification card or driver’s license.Additionally, it is not always possible to completely delete, remove or modify information in CPG’s databases, however, CPG will use commercially reasonable efforts to do so should it be possible subject to the provisions of this Privacy Policy.

You understand that any correction and/or deletion request does not guarantee complete access to or complete deletion of your Personal Information, as the law may not permit or require complete access or deletion in certain circumstances.

How Long Does CPG Retain Information?

CPG maintains your information for no longer than necessary for the purposes for which it was collected and is processed. Thus, the length of time that CPG retains your information depends on the purposes for which it was collected and used and/or as is required to comply with applicable laws. Any Personal Information which is contained in CPG’s or any of its subprocessor’s regular backups will not be deleted, provided that any such Personal Information shall remain subject to the confidentiality and data privacy and security terms and conditions of this Privacy Policy until destroyed.

Does CPG Use Cookies?

When you visit or use the Services, CPG may place a cookie in a file directory on your computer or mobile device. A cookie is a small text file that is placed on your computer or mobile device to uniquely distinguish your visit to a website or use of an online service or mobile application. The information that cookies collect includes the date and time of your visit and your registration information. Cookies may offer you many conveniences for the Services and allow CPG to recognize certain information, such as your browser type, so CPG knows if you can view certain plug-ins or extensions.  They also allow CPG to streamline your visit to and usage of the Services based on your previous visits and usage.Cookies may be either permanent or temporary.  CPG may use both temporary and permanent cookies.  A temporary or “session” cookie is placed on your computer or mobile device during your visit to any of the Services and is deleted when you exit your Internet browser, the mobile application, and/or turn off your computer or mobile device. A permanent or “persistent” cookie means that the cookie stays on your hard drive or mobile device until you delete it. You can delete CPG’s permanent cookie at any time by following the instructions contained in your browser’s help file, or by contacting the company providing your browser’s or mobile device’s technical support.  CPG does not use cookies to store information such as credit card numbers, social security numbers or any other highly sensitive Personal Information.

You may choose what cookies you accept by making a selection in the Cookie Choices available at https://www.cryptopackagedgoods.com/. You may also configure your browser or device to accept or deny cookies from the Services.  However, opting out, disabling or denying cookies from the Services may render parts of the Services inaccessible or may cause certain web pages not to properly load. There are also several services and websites which allow you to visit websites, including the Services, anonymously. Again, you may not be able to access or use all of the content or services available on or in the Services if you use these anonymizing services or websites.  If you change computers or browsers or devices or use multiple computers or browsers or devices or delete CPG’s cookies, you will need to repeat this process for each computer, each browser, and each device.

Does CPG Use Web Beacons/Pixel Tags?

CPG may use “Web Beacons,” sometimes referred to as “pixels,” “clear gifs,” or “web bugs,” which are another way (instead of cookies) of helping to personalize your experience on or in the Services.  Web Beacons are typically invisible to you and are generally embedded in very small clear graphics files. “Pixel Tags” are small strings of computer code that provide a method for delivering a graphic image on a web page or other medium. Pixel Tags allow CPG or a third party who serves the Pixel Tag, to set, read, and modify some of CPG’s cookies. 

CPG may use Web Beacons and Pixel Tags to monitor certain non-personally identifiable information about you, including the URL of the page from which the Web Beacon or Pixel Tag originated, the type of browser used, the IP address of your computer and the time you viewed the Web Beacon or Pixel Tag.  While Web Beacons and Pixel Tags do not collect Personal Information, the information collected by them may be used in conjunction with cookies to identify aggregate information about users of the Services.

What Happens with Do Not Track Requests?

CPG does not currently have the capabilities to recognize the Do Not Track signals, settings or mechanisms, including from any Internet browsers.  Therefore, any selection you make within your Internet browser will not be applied to the Services.  For more information regarding Do Not Track you can visit www.allaboutdnt.org.

Links or Usage of Third Party Websites or Apps/App Stores

The Services may contain links to third-party websites or apps. CPG has no control over the privacy practices or the content of such third-party websites. You acknowledge and agree that neither CPG, nor any of its officers, directors, partners, employees, agents, representatives, vendors or suppliers are responsible for the content, privacy policies, products, services, reliability, viewpoint or accuracy of information on any such websites or apps. CPG does not control and is not responsible for the collection of personal information by third party websites or apps or any websites or apps not controlled by CPG.The app stores (e.g., App Store or Google Play) may collect certain information in connection with your use of the Services, including Personal Information, geolocational information, payment information, and other usage-based data. CPG has no control over the collection of such information by any third-party app store, and any such collection or use will be subject to such third-party app store’s applicable privacy policy.

Under the California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), California residents have certain rights around the collection, use, and sharing of their personal information, including:

The above rights apply only to California residents and only to those sites or entities that meet the requirements to be covered under the CCPA/CPRA. Currently, CPG does not meet these requirements.The CCPA/CPRA defines the “sale” of Personal Information as disclosing, sharing or making such information available to another company or third party “for monetary or other valuable consideration.” The CPRA defines the “sharing” of Personal Information, as disclosure of such information “for cross-context behavioral advertising, whether or not for monetary or other valuable consideration.” Under these definitions, CPG does not sell or share your Personal Information and further will not do so in the future without providing you with notice and an opportunity to opt-out of such sale and/or sharing.  CPG also does not offer financial incentives associated with CPG’s collection, use, or disclosure of your Personal Information. Although CPG does not “share” your Personal Information as defined in the CPRA, you may opt-out of other sharing your Personal Information by emailing CPG at hi@clubcpg.com and as set forth in the Cookie Choices available cryptopackagedgoods.com. For deletion requests, please follow the instructions above.

Under California Civil Code 1798.83, CPG currently does not share any Personal Information with third parties for their direct marketing purposes. Section 1798.83 of the California Civil Code requires select businesses to disclose policies relating to the sharing of certain categories of your personal information with third parties.  If you reside in California and have provided your personal information to CPG, you may request information about CPG’s disclosures of certain categories of personal information to third parties for direct marketing purposes. Within thirty (30) days of receiving such a request, CPG will provide a list of the categories of Personal Information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of those third parties, if any.  This request may be made no more than once per calendar year. CPG reserves the right not to respond to requests submitted other than to the address specified in this Section, requests not labeled or sent properly, or requests that do not have complete information.If you are a California resident under the age of 18, California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information you have publicly posted on or in the Services. To make such a request, please send an email with a detailed description of the specific content or information to hi@clubcpg.com with the subject line “CalBPC 222581 Request.” Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested. For example, CPG may retain the content or information for its own internal records, or potentially a third-party CPG does not own or control may copy the posting and repost it elsewhere.

Governing Law/Jurisdiction

The Services are controlled and operated from CPG’s offices within the State of California, United States of America.  All Disputes are governed by the terms set forth in CPG’s Terms of Service.If you are accessing the Services from any location with regulations or laws governing personal data collection, use or disclosure that differ from United States laws or regulations, please note that through your continued use of the Services, which are governed by the laws of the State of California and the United States of America and this Privacy Policy, you are transferring Personal Information to the United States of America and you consent to that collection, transfer to and any associated processing, usage and storing in the United States of America.

Opt-Out of CPG Communications/Notifications

You may choose to opt-out of receiving electronic communications from CPG. To opt-out of non-transactional electronic communications from CPG, please contact CPG at hi@clubcpg.com (subject line: “Opt-Out Email Communications”) to request that you be unsubscribed from any of CPG’s marketing emails. You must provide your name and email address(es) when making any such request. In addition, you may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any such communication. CPG will use commercially reasonable efforts to process such requests in a timely manner. CPG may also deliver notifications to your mobile device (i.e., push notifications).
